Terms of Service

These Terms of Service (“Terms”) govern your use of SamTech Solutions products and services, including the Domain Monitor mobile app, related websites, backend systems, public status pages, notifications, and subscription features (together, the “Services”). By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 13 years old, or the minimum age required by the laws of your country to use digital services, to use the Services. By using the Services, you represent that you meet this requirement.

2. Your account and use of the Services

You are responsible for your use of the Services, for the targets you choose to monitor, and for keeping your account credentials and sign-in methods secure. You are also responsible for ensuring your use complies with applicable law and with any terms that apply to the systems, domains, URLs, or endpoints you monitor.

3. Acceptable use

• You must not use the Services to overload, disrupt, attack, probe, or abuse any system, network, or service.
• You must not use the Services in violation of applicable law or the rights of others.
• You must not attempt to bypass subscription limits, entitlement checks, access controls, or rate limits.
• You must not reverse engineer, interfere with, or misuse the Services or their supporting infrastructure, except to the extent such restriction is prohibited by applicable law.
• You must not resell, lease, or commercially exploit the Services except with our written permission.

4. Plans, features, and limits

The Services currently offer the following tiers:

• No-account (Free): up to 1 target, local checks only, no cloud monitoring, no notifications.
• Registered (Free): up to 5 targets, local checks only, no cloud monitoring, no notifications.
• Pro (Paid subscription): up to 12 targets, cloud monitoring, and push notifications.

Features, limits, and plan structure may evolve over time. We may add, modify, suspend, or discontinue features or limits, including for security, legal, operational, or product reasons. If we make a material adverse change to a paid plan, we will provide notice where required by applicable law.

5. Subscriptions and billing

• Pro is available as an auto-renewing monthly or annual subscription purchased through Google Play or the Apple App Store, where available.
• Subscriptions automatically renew unless cancelled through the relevant app store before renewal.
• Free trials may be offered from time to time. If you start a paid subscription before a trial ends, any unused portion of the trial may be forfeited.
• Prices, billing currency, taxes, and availability may vary by region and platform.
• Payment, renewal, cancellation, and refunds are handled by the relevant app store under that platform’s terms and policies. We do not process card payments directly and do not issue store-billed refunds directly.
• Deleting your account does not automatically cancel an active subscription. To stop future renewal charges, you must cancel through your Google Play or Apple App Store account settings.

6. Availability, uptime, and monitoring accuracy

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, or perfect monitoring accuracy. Monitoring results, alerts, public status pages, or related data may be delayed, missed, unavailable, or inaccurate due to internet conditions, target behavior, provider issues, third-party outages, maintenance, abuse-prevention controls, or other factors outside our reasonable control.

The Services are a convenience and monitoring tool, not an emergency, safety-critical, or guaranteed incident-detection system. You should not rely on the Services as your sole means of detecting outages or other production issues in critical situations.

7. Suspension and termination

We may suspend or terminate access to the Services, or limit certain functionality, if we reasonably believe you have violated these Terms, created security or abuse risk, exposed us or others to legal risk, or used the Services in a way that could harm the Services or other users.

You may delete your account at any time directly in the App. Account deletion removes your account data from our systems in accordance with our Privacy Policy, but does not automatically cancel any active app-store subscription, which must be cancelled separately through the relevant store.

8. License and intellectual property

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your own internal or personal use. SamTech Solutions and its licensors retain all rights, title, and interest in the Services, including all intellectual property rights. Except as expressly allowed by these Terms or applicable law, you may not copy, modify, distribute, sell, sublicense, or create derivative works from the Services without our written permission.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, SamTech Solutions will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or use, arising out of or related to your use of, or inability to use, the Services, even if we have been advised of the possibility of those damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

11. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence require otherwise.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version here and update the effective date above. If we make material changes, we may also notify you through the Services or by email.
